2. APPLICATION

Any order as any supply by OLDMAGUS involves express acceptance and without reserve of these general conditions which constitute an essential element of the contract and our agreement of will, with you as a purchaser and us as a salesman.

3. CONDITIONS OF ORDER TAKING AND PAYMENTS

You can order the products directly at OLDMAGUS, subject to availability. In the event of non-fulfilment or of execution partial of an order, the responsibility for OLDMAGUS will be strictly limited to the amount for the order (to the proportion in the event of partial execution) and will be able to give place to no additional allowance. For any order for the Metropolitan France, Andorra, Monaco and for the countries of the Economic area European, while clicking on “validating your order” your order is directly opposable with OLDMAGUS. In the event of incident of payment whatever it is, OLDMAGUS limited liability company reserves the possibility of suspending the pending orders and of refusing to deliver all new order until complete payment with the sums due. In the event of refusal to pay of a cheque customer, the expenses of one second presentation of the cheque are the responsibility of the customer. The transfer of property of the delivered products or to deliver is suspended until the integral payment of the price by the customer.

4. REMOTE SALE

Right of retractation. Under the terms of the L121-16 article of the Code of Consumption, the customer has a seven days deadline frank as from the delivery of his order to turn over, with his expenses, the product with OLDMAGUS. The product, which will have to be turned over accompanied by a copy of the invoice, will be exchanged or refunded. The turned over product should not have suffered damage: the product must be complete with its ring of protection of original for the oil bottles of émeu and the gélules or in its packing of origin in good condition for the products cosmeceutic.

5. RESPONSIBILITY

The products distributed by OLDMAGUS are in conformity with the French and European legislations. We recall to our customers that the products of catalogue OLDMAGUS are products of form and to be well and cannot in no case to be regarded as drugs in their composition or their form and presentation. OLDMAGUS could not be held for person in charge for the possible disadvantages which have occurred following a use not-in conformity with the councils related on the product and its packing. OLDMAGUS does not incur any responsibility, as well with respect to its customer as some third than it is, with the title of the diffusion of the products appearing in its catalogue.

6. SHARE IN THE EXPENSES OF TREATMENT AND FORWARDING

The prices, establish all inclusive of tax and in euros, are those in force at the time of the order. The prices do not include/understand the share in the expenses of treatment and forwarding by Colissimo. This share in the expenses of treatment and forwarding is calculated according to the weight of the order and by sections of 1 Kilo. A tariff is applicable for France and another for the EEC and Switzerland. 7. DELIVERY

Except unavailability, OLDMAGUS guarantees the preparation and the forwarding of the order by Colissimo in the three wrought days as of complete payment of the order. To know the delivery periods, you must add to the time of treatment of the three day old order, the postal times of forwarding which are a function enter different of the address of delivery. The delivery periods can vary in the event of difficulties of routing, of out-of-stock condition, at the periods of holidays which will then be announced by email to the customer. CASE OF ABSOLUTE NECESSITY The responsibility for OLDMAGUS could not be committed in the case of cause beyond control such as the strikes, the fires, the natural disasters, the acts of terrorism, the destruction total or partial of buildings and installations of manufacture, the disturbances in transport, or others, this list not being exhaustive.

9. MARKS/MENTION

Any mention or use of marks, names, initials, logos, colors, graphics or other, pertaining or deposited by OLDMAGUS and MOVED ORIGINAL DUNDEE, is strictly prohibited except approval preliminary and written OLDMAGUS and MOVED ORIGINAL DUNDEE. Any modification of packing of origin or the mentions related to packing or the products is strictly prohibited.

10. GUARANTEE

The products offered with the sale by OLDMAGUS are the subject of checking and vehicle inspections. If despite everything the care taken to the manufacture of these products, an article were defective, the customer has thirty days frank to turn over it to his expenses in his packing of origin and accompanied by the invoice. If the defect would be noted, one to have would be automatically generated with the profit of the customer who will be able to then choose either another product for an equivalent price, or refunding. In the case of a proven defect, the carriage costs will be refunded with the customer by OLDMAGUS.

11. DATA PROCESSING AND FREEDOMS

12. ATTRIBUTION OF JURISDICTION
